Cruelty and Non-Support

Myrtle F. Hathaway, of this city, wants to be divorced from Edward T. Hathaway on the grounds of cruelty and non-support. Her maiden name was Coughenour and the couple was married by a Justice of the Peace at Alma, Neb. August 10, 1893. They have two children; Leonard, aged 10 and Nellie, aged 7. Mrs Hathaway related a number of instances of alleged abuse and ill treatment and charges among other things that her husband assaulted and kicked her in the present of company whom she was entertaining. She charges her husband to be lazy and shiftless and says she has worked out to secure her clothing. In September, 1903, Mrs. Hathaway filed a bill for divorce but later dismissed the case upon promise of her husband to be good and take care of the family. In the absence of Judge Smith, Circuit Court Commissioner Matthews granted an injunction preventing Hathaway from molesting or abusing his family or from disposing of any of the personal property they have. The wife asks a divorce, alimony and the care of the children until they are 14 years of age.
