Joseph was divorced from his first wife Sarah, in 1862,  on the gounds of adultery, Sarah stated that Joseph had an affair with Elizabeth M. Odell and Eliza Griswold in 1860-61. The first case Sarah filed was dismissed, she refiled, brought witnesses that stated that Joseph had frequently struck Sarah and at times threw her to the ground.
